2. THE DATA WE COLLECT ABOUT YOU

Personal data, or personal information, is any information about an individual from which that person can be identified. It does not include anonymous data where the identity has been removed.

We may collect, use, store, and transfer different kinds of personal data about you, which we've grouped as follows:

  • Identity Data: Includes first name and last name.
  • Contact Data: The data we use to contact you, including your billing address, delivery address, email address, and telephone number.
  • Financial Data: The data we use to process your payments, including payment card details. We do not store or process your card details ourselves; they are processed and stored by one of our third-party service providers. We encrypt your payment card details in your browser and securely transfer this data to our relevant third-party payment provider.
  • Transaction Data: Details about transactions you've made on our website, including payments to and from you, and other details of products and services you've purchased.
  • Technical Data: Details about the device(s) you use to access our website, including your IP address, browser type and version, location, operating system, and other technology on the devices you use.
  • Profile Data: Includes your email address and password, login data, purchases or orders, interests, preferences, feedback, and survey responses.
  • Usage Data: Information about how you use our website, products, and services. This includes your browsing patterns, how long you spend on webpages, what you look at, click streams, page response times, and page interaction information like scrolling and clicks.
  • Marketing and Communications Data: Your preferences in receiving marketing from us and your communication preferences.

We also collect, use, and share aggregated and/or anonymized data (“Aggregated Data”), such as statistical or demographic data. Aggregated Data may be derived from your personal data but does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific feature. However, if we combine this with your personal data to identify you, we will treat the combined data as personal data.

IF YOU FAIL TO PROVIDE PERSONAL DATA

If we need to collect personal data by law or under the terms of a contract with you, and you fail to provide that data when requested, we may not be able to perform the contract. For example, if you do not provide delivery instructions, we may have to cancel your order. We will notify you if this happens.

3. HOW IS YOUR PERSONAL DATA COLLECTED?

We use different methods to collect data from and about you, including:

  • Direct interactions: You may give us your Identity, Contact, Transaction, Profile, Financial, and Marketing and Communications Data by using our website, filling in forms, or corresponding with us by post, phone, or email. This includes data you provide when you:
    • Purchase a product or service.
    • Create an account.
    • Request marketing.
    • Enter a competition.
    • Give us feedback.
  • Automated technologies or interactions: As you interact with our website, we may automatically collect Usage Data and Technical Data about your equipment, browsing actions, and patterns using cookies, server logs, and other similar technologies.

4. THIRD-PARTY SOURCES OF DATA/DATA SHARING

We also collect and share data with the following providers:

  • Essential Service Providers: Other businesses may give us data about you, such as Financial or Transaction Data, which we need for our legitimate business interests or to perform our contract with you. This happens when we use third-party payment providers who tell us you have paid for your products and may provide us with your Contact and Transaction Data. We may also engage third-party contractors for technical or delivery services.
  • Professional Advisers and Investors: We may share your data with professional advisers like lawyers and insurers to manage legal risks and claims, or as part of our relationship with investor organizations. This is in our legitimate interests.
  • Group: If we sell our business or reorganize, we may need to share your data with the buyer and their advisers, as our customer database is a significant asset. This is in our legitimate interests of selling our business. We may also share your data within our group of companies to improve products and services and for cost efficiency.
  • Law Enforcement/Legal Compliance: We will cooperate with third parties to enforce their rights and with law enforcement requests. This may include disclosing your personal information to government or law enforcement agencies when we believe it's required by law or necessary to protect our legal rights, those of third parties, or to comply with a legal process. These uses are in our legitimate interests of protecting our business.

The lawful bases for sharing and processing this data are set out in the table below.

5. HOW WE USE YOUR PERSONAL DATA

We will only use your personal data when the law allows us to. Most commonly, we will use it when:

  • We need to perform the contract we are about to enter into or have entered into with you.
  • It is necessary for our legitimate interests (or a third party's) and your fundamental rights don't override those interests.
  • We need to comply with a legal or regulatory obligation.

See the Glossary at the end for more on these lawful bases.

Generally, we don't rely on consent as a legal basis for processing personal data, except for sending third-party direct marketing via email or text. You can withdraw your consent at any time.

PURPOSES FOR WHICH WE WILL USE YOUR PERSONAL DATA

We do not conduct any automated decision-making. We may occasionally profile customers for marketing purposes to ensure our marketing is relevant. For example, we might classify an audience for a promotion based on what products they have previously viewed. We do not conduct online behavioral tracking.

MARKETING

We may use your Identity, Contact, Technical, Usage, and Profile Data to form a view on what you might want or need. This helps us decide which products and offers are relevant for you. We only use data you provide directly, along with Aggregated Data from our analytics partners. We don't track other websites you visit, though we may register the site that referred you to us (e.g., a search engine).

We generally only send electronic marketing to people who have previously bought similar products from us, which is in our legitimate interests. We will always offer a way to opt out of this marketing. Where you haven't previously bought from us, we will only send marketing if you have expressly consented.

We may also share certain data with third-party social media platforms to show you targeted ads, either through the use of cookies or by providing your email address to create "audiences." This is in our legitimate interests of direct marketing.

OPTING OUT

You can ask us to stop sending you marketing messages at any time by logging into your account and adjusting your email preferences, following the opt-out links in any marketing message, or by contacting us.

If you opt out of email marketing, we will no longer share your email address with social media platforms. However, you may still see our ads through them due to their general demographic targeting.

Opting out of marketing messages will not affect personal data provided as a result of a purchase or related correspondence, and we will continue to process that data as permitted by law.

COOKIES

You can set your browser to refuse all or some cookies, or to alert you when websites set or access them. Note that if you disable cookies, some parts of the website may not function properly. For more information, please see our Cookies Policy.

CHANGE OF PURPOSE

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another compatible reason. If we need to use your personal data for an unrelated purpose, we will notify you and explain the legal basis. We may process your data without your knowledge or consent where required or permitted by law.

6. DISCLOSURES OF YOUR PERSONAL DATA

We require all third parties to respect the security of your personal data and use it only for the purposes we specify in our contract with them. We will always work with them to protect your privacy.

7. INTERNATIONAL TRANSFERS

Some of our External Third Parties are based outside the European Economic Area (EEA), so their processing of your personal data will involve a data transfer outside the EEA.

Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is in place by implementing one of the following safeguards:

Please contact us if you want further information on the specific mechanism used for your personal data.

8. DATA SECURITY

We have security measures in place to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way. We limit access to your data to employees, agents, and contractors who have a business need to know and are subject to a duty of confidentiality.

We have procedures to deal with any suspected personal data breach and will notify you and any applicable regulator if we are legally required to do so.

You acknowledge that the Internet is not a completely secure medium for communication, and we cannot guarantee the security of any information you send to us. We are not responsible for any damages resulting from the loss of confidentiality of such information.

9. DATA RETENTION

HOW LONG WILL YOU USE MY PERSONAL DATA FOR?

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for legal, accounting, or reporting requirements.

To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the data, the potential risk of harm from unauthorized use, the purposes for which we process it, and applicable legal requirements. For example, order details are generally kept for 7 years to comply with our legal obligations.

In some circumstances, we may anonymize your personal data (so it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice.

10. YOUR LEGAL RIGHTS

Under certain circumstances, you have rights under UK data protection laws regarding your personal data.

You have the right to:

  • Request access to your personal data to receive a copy and check that we are lawfully processing it.
  • Request correction of inaccurate or incomplete data.
  • Request erasure of your personal data where there is no good reason for us to continue processing it.
  • Object to processing of your personal data where we rely on a legitimate interest and you feel it impacts your fundamental rights. You also have the right to object to processing for direct marketing.
  • Request restriction of processing of your personal data in certain scenarios (e.g., if you want us to establish its accuracy).
  • Request the transfer of your personal data to you or a third party in a structured, commonly used, machine-readable format.
  • Withdraw consent at any time where we are relying on consent to process your personal data.

To exercise any of these rights, please Contact Us and mark your query for the attention of the DPL.

NO FEE USUALLY REQUIRED

You will not have to pay a fee to access your personal data or exercise any other rights. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. We may also refuse to comply in these circumstances.

WHAT WE MAY NEED FROM YOU

We may need to request specific information to confirm your identity and ensure your right to access your personal data. This is a security measure to prevent unauthorized disclosure. We may also contact you for further information to speed up our response.

TIME LIMIT TO RESPOND

We try to respond to all legitimate requests within one month. If your request is particularly complex or you have made a number of requests, it may take longer. We will notify you and keep you updated in such cases.
